Marriage Different Religion in Indonesia Perspective Maqasid Shariah Ash Ishaq As-Syatibi

There are two different categories of marriage religions in Islam. The first is the marriage between a Muslim man and a non-Islamic Bible woman. This research uses library research that is a series of activities related to collection of library data, reading and recording, and processing research materials. The Scripture explains that, according to Surah Al Baqarah verse 221, marriage between a Muslim man and a non-Muslim woman is prohibited by law. However, Islam prohibits such marriages to keep families happy. According to Abu Ishaq Asy-Syatibi, maqashid shariah is an important component that can help in three ways: to establish the law on matters not included in the Koran and Sunnah through language study, then to understand the content of the Qur'an and the Sunnah and resolve the arguments that contradict it. In the case of different religious marriage rules in Indonesia, the concept of maqashid shariah means keeping religion on the dharuriyat element, soul on the tahsiniyat element, reason on the Dharuriyah element, descent on the Dharuriyah element, and wealth on the dharuryat element for the reasons contained in the two rules. Thus, the law of marriage between different religions almost meets the five elements of the conception of maqashid sharia, and is in line with SEMA No. 2 Year 2023 on marriage between different faiths in Indonesia.
