Abstract

God created humans in pairs in the container of marriage, both are required to complement each other and have a sense of affection. Marriage is a basic element in the life of a perfect society, it is said so because of the opinion of one of the scholars who said, carrying out marriage means perfecting half of one's religion. Islam recommends marriage, namely marriage that is appropriate and meets the requirements along with its pillars so that it becomes a servant's worship to his creator. Marriage or marriage is also regulated in positive law in Indonesia, as in Law No. 1 of 1974 concerning marriage. Marriage is a physical and spiritual bond between a man and a woman to form a happy, eternal family based on the One Almighty God. In this study the author uses a descriptive-comparative method that uses library research . Namely, the data collected refers to Islamic law and Law No. 1 of 1974 concerning marriage and several Hadiths of the Prophet. Marriage has the purpose of build the family that harmonious, eternal as well as get descendants who Good, by Therefore, it requires very deep preparation in carrying out the marriage, both in terms of formality. and material as well as great mental and financial readiness. the validity of a marriage depends on the religion and beliefs of each, the husband and wife must be mature both in body and soul, making it difficult for divorce to occur and equal rights and positions for husband and wife, so that they can obtain peace of life in the household and have good offspring.
